FARANANI TERMS AND CONDITIONS
These Terms and Conditions (“Terms”) govern all use of the FARANANI website, online stores, quotations, invoices, catalogues, electronic communications, WhatsApp orders, email orders, telephonic orders, in-store transactions and all purchases of products and services from FARANANI.
By accessing our website, placing an order, accepting a quotation, making payment or purchasing products from FARANANI, you acknowledge that you have read, understood and agreed to be bound by these Terms.
1. COMPANY INFORMATION
FARANANI provides information technology products, office automation products, consumables, telecommunications products, electronics, accessories, services and related solutions within South Africa.

2. APPLICATION OF TERMS
2.1 These Terms apply to all transactions between FARANANI and customers unless otherwise agreed in writing.
2.2 Any terms proposed by a customer which conflict with these Terms shall not apply unless expressly accepted by FARANANI in writing.
2.3 FARANANI reserves the right to amend these Terms at any time without prior notice.

3. PRODUCTS AND SERVICES
3.1 FARANANI sells products based on manufacturer specifications, supplier information and product descriptions available at the time of listing.
3.2 Product images are illustrative only and actual products, packaging, colours, accessories or branding may differ.
3.3 FARANANI does not warrant that all product descriptions, pricing, specifications or images are error-free.
3.4 FARANANI reserves the right to correct errors, inaccuracies or omissions at any time without liability.
3.5 Availability of products is subject to supplier stock availability.
3.6 FARANANI reserves the right to discontinue products or services without notice.
4. CUSTOMER RESPONSIBILITIES
4.1 Customers are solely responsible for ensuring that products ordered are suitable, compatible and correct for their intended purpose.
4.2 FARANANI shall not be liable for:
- incorrect orders placed by customers;
- compatibility issues;
- configuration issues;
- software incompatibility;
- installation issues;
- customer misunderstandings regarding specifications or functionality.
4.3 Customers must verify all quotations, invoices, quantities, specifications and model numbers before payment.
4.4 Any advice provided by FARANANI staff is general in nature and does not constitute professional technical consultation unless expressly agreed in writing.
5. PRICING
5.1 All pricing is subject to change without notice.
5.2 Prices displayed are subject to supplier pricing fluctuations, exchange rate movements and stock availability.
5.3 Quotations are valid only for the period stated on the quotation.
5.4 Pricing errors may occur and FARANANI reserves the right to cancel any order arising from incorrect pricing.
5.5 All prices include VAT unless otherwise stated.
6. ORDERS
6.1 Orders are only deemed accepted once:
- payment has been received and cleared; or
- FARANANI has confirmed acceptance in writing.
6.2 FARANANI reserves the right to:
- refuse any order;
- cancel any order;
- limit quantities;
- request additional verification;
- decline suspicious or fraudulent transactions.
6.3 Orders may not be cancelled once products have been specially sourced, ordered from suppliers, customized, configured or dispatched.
6.4 Special-order products may require deposits or full upfront payment.
7. PAYMENT TERMS
7.1 FARANANI accepts payment methods approved on its website or invoices.
7.2 Payment verification may delay order processing.
7.3 Ownership of goods shall remain vested in FARANANI until payment has been received in full.
7.4 FARANANI reserves the right to suspend delivery where payments remain outstanding.
7.5 Business account customers agree that overdue accounts may attract:
- interest;
- collection costs;
- legal fees;
- tracing fees;
- administrative fees.
7.6 Chargebacks or payment reversals without lawful basis may result in legal action.
8. CREDIT CARD AND ONLINE PAYMENTS
8.1 FARANANI does not store customers’ full card details.
8.2 Online payments are processed through secure third-party payment gateways.
8.3 FARANANI reserves the right to request:
- identity verification;
- proof of address;
- banking confirmation;
- anti-fraud verification.
8.4 Orders suspected of fraud may be delayed, cancelled or reported to relevant authorities.
9. DELIVERY
9.1 Delivery times are estimates only and are not guaranteed.
9.2 FARANANI shall not be liable for delays caused by:
- suppliers;
- couriers;
- load shedding;
- strikes;
- customs delays;
- force majeure events;
- network failures;
- incorrect customer information.
9.3 Risk in goods passes to the customer upon delivery or collection.
9.4 Customers must inspect goods immediately upon delivery.
9.5 FARANANI does not deliver to PO Boxes unless expressly agreed.
9.6 Failed deliveries due to customer error may attract additional delivery fees.
9.7 Refused or undeliverable shipments may attract:
- collection fees;
- delivery charges;
- administration charges;
- restocking fees of not less than 25%.
10. COLLECTIONS
10.1 Customers collecting goods may be required to provide:
- proof of identity;
- proof of payment;
- order confirmation.
10.2 FARANANI reserves the right to refuse release of goods where fraud is suspected.
10.3 Goods collected by third parties are released entirely at the customer’s risk.
11. STOCK AVAILABILITY
11.1 Stock levels displayed online may not always reflect real-time availability.
11.2 FARANANI reserves the right to place orders on backorder where stock becomes unavailable.
11.3 Where FARANANI cannot supply a paid order within a reasonable period, the customer may receive:
- a refund;
- store credit;
- substitute product options.
11.4 FARANANI shall not be liable for losses arising from stock shortages.
12. RETURNS, WARRANTIES AND REFUNDS
12.1 Returns are governed by the FARANANI Returns & Refunds Policy.
12.2 Warranty claims are subject to supplier and manufacturer approval.
12.3 FARANANI acts primarily as reseller and intermediary unless expressly stated otherwise.
12.4 Products returned as defective may be tested.
12.5 If no fault is found, testing and handling fees may apply.
12.6 Special-order, configured, custom or non-returnable products may not be eligible for refunds.
13. CPA AND ECTA COMPLIANCE
13.1 FARANANI complies with applicable South African consumer legislation including:
- the Consumer Protection Act 68 of 2008 (“CPA”);
- the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”);

13.2 Nothing in these Terms is intended to unlawfully limit consumer rights.
13.3 Where transactions are exempt from CPA protections, these Terms shall apply fully.
14. INTELLECTUAL PROPERTY
14.1 All content on the FARANANI website including:
- logos;
- branding;
- product listings;
- graphics;
- text;
- software;
- designs;
- catalogues;
- documentation,
remains the property of FARANANI or its licensors.
14.2 No content may be copied, reproduced, distributed or exploited without written permission.
15. WEBSITE USE
15.1 Users may not:
- upload malicious software;
- attempt unauthorized access;
- interfere with website functionality;
- scrape data;
- misuse the website;
- distribute spam;
- engage in unlawful conduct.

- error-free operation;
- compatibility;
- uninterrupted supplier availability;
- suitability for specific purposes.
17.3 Manufacturer warranties remain subject to manufacturer terms and conditions.
18. LIMITATION OF LIABILITY
18.1 To the fullest extent permitted by South African law, FARANANI shall not be liable for:
- indirect damages;
- consequential damages;
- special damages;
- loss of profits;

18.2 FARANANI’s total liability arising from any transaction shall not exceed the purchase price paid for the relevant product or service.

20. FORCE MAJEURE
FARANANI shall not be liable for delays or failures caused by events beyond its reasonable control including:

- load shedding;
- cyber attacks;
- internet outages;
- import restrictions;
- transport disruptions.
21. POPIA AND PRIVACY

21.2 Customer information may be used for:
- order fulfilment;
- fraud prevention;
- customer communication;
- legal compliance.
21.3 FARANANI will not unlawfully sell or disclose personal information.

22. ELECTRONIC COMMUNICATIONS

26. ENTIRE AGREEMENT
These Terms together with FARANANI’s Returns Policy, Privacy Policy, quotations and invoices constitute the entire agreement between FARANANI and the customer.

IMPORTANT CUSTOMER ACKNOWLEDGEMENT
By placing an order with FARANANI, the customer acknowledges that:
- they have read and accepted these Terms;
- they understand the product specifications ordered;
- they accept that compatibility verification is their responsibility;
- supplier and manufacturer warranty terms may apply independently of FARANANI;
- returns and refunds remain subject to FARANANI policies and applicable South African law.
